USTR Requests Comment on Extensions for Five Rounds of List 4A Exclusions
The Office of the United States Trade Representative (USTR) is seeking public comment regarding the extension of exclusions granted across five rounds of Section 301 List 4A exclusions. These five rounds of product exclusions are currently set to expire on September 1, 2020, and an extension would add another year of validity.
The five rounds under discussion for extended exclusions include:
- 85 FR 13970 (March 10, 2020)
- 85 FR 15244 (March 17, 2020)
- 85 FR 17936 (March 31, 2020)
- 85 FR 28693 (May 13, 2020)
- 85 FR 35975 (June 12, 2020)
Comments can be submitted through a web portal at https://comments.ustr.gov/ starting July 1, 2020. To be assured of consideration, written comments must be submitted by July 30, 2020.
The focus of USTR’s evaluation will be whether the particular product remains available only from China. In addition, USTR will consider whether the imposition of additional duties will result in severe economic harm to the commenter or other U.S. interests.
