USTR Releases Product Exclusions for List 3 Products, Seeks Comment on Medical Products
The Office of the United States Trade Representative (USTR) released an additional set of product exclusions for Section 301 List 3 products from China.
The new set of tariff exclusions contain 1 HTS subheading completely excluded from 25% tariffs, covering 1 exclusion request, and 176 partially excluded subheadings, covering 202 separate requests.
This round of exclusions will retroactively apply to all List 3 products meeting the specified criteria effective September 24, 2018 up through August 7, 2020. As was the case with previous exclusions, importers with eligible products are able to claim exemption under the new exclusions regardless of whether the importer filed an exclusion request.

USTR is also asking the public to submit comment on any medical products that should be excluded from Section 301 tariffs in response to COVID-19. Each comment must identify the particular product and explain how it relates to the response to the COVID-19 outbreak, such as how it is used to limit the outbreak or is used in the production of needed medical-care products.
