USTR Releases First Round of Section 301 List 2 Product Exclusions
The Office of the United States Trade Representative (USTR) released the first list of HTS subheadings that are partially excluded from Section 301 List 2 tariffs. This notice includes 69 HTS subheadings, which cover 292 separate exclusion requests.
HTS subheadings granted partial exclusion from List 2 25% Tariff Increase:
- 3901.90.1000, 3904.61.0090, 3906.90.2000, 3907.20.0000, 3919.90.5060, 3919.90.5060, 3920.10.0000, 8407.90.1020, 8407.90.9010, 8407.90.9040, 8419.89.9585, 8424.89.9000, 8432.29.0060, 8432.42.0000, 8465.95.0055, 8483.30.8020, 8501.10.6020, 8501.10.6080, 8501.31.8010, 8501.52.4000, 8503.00.9520, 8536.30.8000, 8537.10.3000, 8541.10.0050, 8543.70.4500, 8543.70.9960, 8607.30.1000, 8711.10.0000, 9001.20.0000, 9025.19.8040, 9025.19.8080, 9025.80.1000, 9028.10.0000, 9028.20.0000 and 9029.20.4080
These exclusions will retroactively apply to all List 2 products meeting the criteria effective August 23, 2018 — the date the U.S. first imposed the 25% tariff on $16 billion in Chinese products. Additionally, importers with eligible products are still able to claim exemption under the new exclusions up to one year from the date the official notice is posted in the Federal Register.
