USTR Releases Additional Product Exclusions for List 1, 2 and 3 Products
The Office of the United States Trade Representative (USTR) released additional product exclusions for Section 301 List 1, List 2, and List 3 products.
List 1 (official notice)
The List 1 notice includes 310 HTS subheadings partially excluded from 25% tariffs, which cover 724 separate exclusions requests. These exclusions will retroactively apply to all products meeting the criteria effective July 6, 2018.
List 2 (official notice)
The List 2 notice includes 89 HTS subheadings partially excluded from 25% tariffs, which cover 400 separate exclusions requests. These exclusions will retroactively apply to all products meeting the criteria effective August 23, 2018.
List 3 (official notice)
The List 3 notice includes 38 HTS subheadings partially excluded from 25% tariffs, which cover 46 separate exclusions requests. These exclusions will retroactively apply to all products meeting the criteria effective September 24, 2018
For List 1 and 2, and as was the case with previous exclusions, importers with eligible products are able to claim exemption under the exclusions up to one year from the date the official notice is posted.
However, USTR announced that additional List 3 product exclusions will expire on August 7, 2020. According to USTR, a full year of exemption eligibility would result in “disparities in the effective periods between exclusions granted early in the exclusion process and those granted later.”
