USTR Extends Effective Entry Date for Section 301 List 3 Tariffs, Upcoming Hearings on List 4

Last Friday, the Office of the United States Trade Representative (USTR) published a notice announcing that List 3 goods shipped prior to May 10th will NOT be subject to the additional 15% in duties (from 10% to 25%) if they arrive before June 15th.

Originally, the goods included on List 3 needed to arrive prior to June 1st to avoid the 15% tariff increase. Under the new extension, cargo that departed prior to May 10th can now arrive prior to or on June 15th and still retain the 10% tariff level. We would like to stress that this announcement applies only to cargo shipped prior to May 10th.

Customs and Border Protection (CBP) has indicated that programming is not yet in place for this amendment. Brokers will need to apply for refunds on their customers’ behalf for any effected shipments.

Additionally, the USTR will begin hearings on June 17 regarding the proposed 25% tariff increase on List 4 products, covering nearly all products from China and totaling $300 billion in goods. The hearing will be followed by a seven day comment period in which all final rebuttal comments must be submitted.
