USTR Releases Fourth Round of Section 301 List 1 Product Exclusions

On May 14, the Office of the United States Trade Representative (USTR) released a fourth round of Section 301 List 1 product exclusions. This notice includes five HTS subheadings completely excluded from the tariff increase, and 35 subheadings partially excluded — including:

HTS subheadings granted complete exclusion from List 1 25% Tariff Increase:

  • 8407.21.0040, 8427.10.4000, 8473.40.1000, 8481.10.0090 and 8483.50.9040.

HTS subheadings granted partial exclusion from List 1 25% Tariff Increase:

  • 8421.21.0000, 8421.39.8015, 8428.39.0000, 8438.80.0000, 8481.90.9040, 8501.10.4060, 8501.52.8040, 8505.90.7501, 8526.92.5000, 8529.90.8100, 8536.49.0075, 8536.50.9035, 8536.50.9040, 9011.10.8000, 9011.90.0000 and 9018.20.0040.

This recent round of exclusions will retroactively apply to all products meeting the criteria effective June 6, 2018 — the date the U.S. first imposed a 25% tariff increase on $34 billion of Chinese products. Additionally, importers with eligible products are still able to claim exemption under the new exclusions up to one year from the date the official notice is posted in the Federal Register.
