USTR Releases Additional Product Exclusions for Certain List 3 Products

The Office of the United States Trade Representative (USTR) released additional product exclusions for certain Section 301 List 3 products from China.

The new set of tariff exclusions contain 2 HTS subheadings completely excluded from 25% tariffs, and 34 subheadings partially excluded, covering 42 separate requests. This round of exclusions will retroactively apply to all List 3 products meeting the specified criteria effective September 24, 2018 up through August 7, 2020.

As was the case with previous exclusions, importers with eligible products are able to claim exemption under the new exclusions regardless of whether the importer filed an exclusion request.
